Before using our services, please carefully read and understand the following Terms of Use (the "Terms") that govern your access to and use of the Portal. By accessing or using the Portal, user ("you" "your" "client" "client" "jobseekers" "employers") agree to comply with and be bound by these Terms. If you do not agree with these Terms, please do not use the Portal.

1. Acceptance Of Terms
By accessing or using the Portal, you affirm that you are of legal age to enter into this agreement and accept these Terms on your behalf or on behalf of any entity or person you represent. If you are using the Portal on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms, by using our application, you indicate your agreement to be bound by these Terms.
Changes To Terms
We reserve the right to modify or update these Terms at any time. Changes will be effective upon posting on the Portal. Your continued use of the Portal after such changes will constitute your acceptance of the updated Terms. We suggest that you visit our website regularly to keep up to date with any changes. Use Of The Portal
1. The Portal is intended for personal use by job seekers and employers for the purpose of connecting job opportunities with candidates.
2. You agree not to use the Portal for any unlawful, fraudulent, harmful, tortious, defamatory, libellous, abusive violent purpose.
3. You prohibit to use the Portal to post any pyramid scheme or multi-level marketing scheme on the Portal.
4. You may not ask or require whatsoever the reason for any candidate to pay a fee, charge, cost or any money in connection with the hiring process for any job advertised on the Portal.
5. All files delivered to us will be free of infection or viruses.
6. You may not upload, post, or transmit any content that is defamatory, obscene, hateful, or discriminatory.
7. You also agree not to use any of our websites and applications for commercial purposes without permission.
8. You may not use automated scripts or bots to access or interact with the Portal.
9. You understand that all content you upload is entirely the responsibility of the individual who creates/uploads the content.
10. You agree not to transfer your rights or obligations under these Terms.
11. You may not engage in any activity that disrupts or impairs the operation of the Portal.
12. You acknowledge that we cannot guarantee that our websites and applications will not be disrupted, error-free, free from interference, or that the websites and applications, as well as our servers, are free from viruses or other harmful mechanisms.
Anti-Fraud Reminder
There might be a lot of parties claiming to be part of PT Prima Bersama Berkat ("BOSSHIRE", "we","us", or "our") and offering irresponsible jobs.

In connection with this, BOSSHIRE would like to inform you the distinctive characteristics of official consultants from BOSSHIRE when offering jobs.
1. We never charge jobseekers/candidates any fees.
2. BOSSHIRE only charge company/client that use our services for job posting.
3. We always use polite and proper language, follow the recruiters ethics and do the recruitment in a professional way.
4. We will not ask for your sensitive information such as passwords and bank account details etc.
5. BOSSHIRE Consultants will only email you using @bosshire.com emails. This is the only official domain.
If you receive or unsure about message/approach from those claiming representative of BOSSHIRE, or if you come across fraudulent actors posing as recruiters to retrieve sensitive information, please do not respond and report to us immediately.

BOSSHIRE reserves the legal rights available under the laws of the Republic of Indonesia to take legal action against irresponsible parties who impersonate the recruitment team of BOSSHIRE.
Intellectual Property
1. BOSSHIRE owns all intellectual property rights associated with our websites and BOSSHIRE retains all intellectual property rights in our websites.
2. You agree that BOSSHIRE may reproduce, distribute, transmit, create derivative works of, and publicly display any materials and other information that you submit to any public areas of our websites or directly to us by email. You understand that you will not be compensated for your ideas and feedback.
3. BOSSHIRE does not own any pre-existing intellectual property owned by you (an example of which may be your company logo). However, you agree to provide us with a perpetual, import, copy, distribute, non-transferable, royalty free licence to use your intellectual property in the products and services we provide to you. If you withdraw this licence, we may be unable to provide services to you.
4. You must keep intact all and any copyright and proprietary notices. You may not otherwise reproduce, modify, copy or distribute or use for non-personal or commercial purposes any of the materials or Content on our websites without prior written permission from us.
Content
1. You retain ownership of any content you submit or post on the Portal, but by doing so, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and reproduce that content.
2. We do not endorse or verify the accuracy of any content posted by users, and we are not responsible for any content posted by users.
3. For Clients, you must ensure that all hiring posted to the comply with all applicable legislation, regulations, by-laws, ordinances, including but not limited to the:
1. Law No. 27 of 2022 Personal Data Protection Law.
2. Law No. 8 of 1999 on Consumer Protection.
3. Law No. 13 of 2003 on Manpower as amended by Law Law No. 6 of 2023.
4. Government Regulations No. 35 of 2021.
Termination
We reserve the right to terminate or suspend your access to the Portal, with or without notice, for any violation of these Terms.

Privacy use of the Portal is subject to our "Privacy Policy", which is incorporated by reference into these Terms. Please review our "Privacy Policy" to understand how we collect, use, and protect your personal information.
Disclaimer Of The Portal Warranties
The Portal provided "as is" and "as available" without any warranties of any kind, either expressed or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

BOSSHIRE shall not be liable for any loss of information howsoever caused as a result of any interruption, suspension or termination of our services or for Content, accuracy or quality of information available or transmitted through our Services.

If permitted by applicable law, BOSSHIRE shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, arising out of your access to or use of the Portal including but not limited relating to Intellectual Property.
Governing Law
These Terms are governed by and construed in accordance with the laws of Indonesia. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Indonesia.
